General terms and conditions of business

(The following General Terms and Conditions also contain legal information on your rights under the provisions on distance selling and electronic commerce.)

1. Scope

These General Terms and Conditions (GTC) apply to all deliveries from Eichenhain.com, c/o Scanbox #00307, Ehrenbergstr. 16A, DE-10245 Berlin (hereinafter: us) to consumers (§ 13 BGB) and businesses (§ 14 BGB). If individual points only concern consumers or businesses, this is explicitly stated.

2. Contracting party

The purchase contract is concluded with Eichenhain.com, owner Bertrand Dahi, Alte Eisenacher Str. 25, DE-99834 Gerstungen.

3. Contract language

The contract language is German.

4. Right of withdrawal for consumers and statutory liability for defects

For information on your right of cancellation as a consumer, see here . You can find the sample cancellation form here . Irrespective of your right of cancellation, you have statutory liability rights for defects.

5. Ordering process, delivery and invoice

5.1 The order is placed by placing the desired products in the shopping cart, going to the checkout and entering your data required for the order, such as the delivery address and billing address, either as a guest without an account or as a registered customer. You will then have the opportunity to check that the order is correct before you confirm the order and send it to us by clicking on the button that informs you that you are obliged to pay for the order.

5.2 We ship with DHL, usually the next working day after receipt of payment, unless there is any problem with the order that needs to be resolved first.

5.3 There is no invoice included with the delivery. However, we will be happy to send you one by email as a PDF file if you wish. Simply write us a short message. Of course, you can also print out the shipping confirmation for your records.

6. Payment

6.1 Payment can be made either in advance, by credit card or through various payment service providers such as PayPal, Sofort and Giropay. Payment can also be made in crypto currencies; however, refunds, e.g. in the event of a cancellation, are made in the original crypto currency at the current exchange rate. The euro price is therefore always decisive.

6.2 If you choose to pay in advance, we will give you our bank details in the order confirmation. The goods will be dispatched after receipt of payment. Payment is due within 5 working days.

7. Retention of title

The goods remain our property until full payment has been made.

8. Warranty

We will refund the purchase price within 30 days if you are unhappy with the goods. Simply let us know and we will send you a return slip within Germany. Outside of Germany, we ask that you pay for the shipping yourself.

In good faith, this only includes normal testing. Of course, you can't eat 96% of the product and then send it back (as has actually already happened). :)

This guarantee is independent of your statutory rights (see point 4).

9. Product reviews

Product reviews are "verified" if the email address provided for the review comes from a customer.

We delete reviews that are objectively incorrect. By "objectively incorrect" we mean, for example, a bad product review although or because the product has not yet been delivered.

10. Applicable law and jurisdiction agreement for entrepreneurs

This Agreement and any dispute or matter arising out of or relating to this Agreement or its subject matter or formation shall be governed in all respects by the laws of Germany, excluding (i) any principles of conflicts of law and (ii) the United Nations Convention on Contracts for the International Sale of Goods (CISG), as amended or suspended from time to time.

The parties irrevocably submit to the exclusive jurisdiction and venue of the courts of the Seller’s registered office in respect of any dispute or matter arising out of or in connection with this Agreement or its subject matter or formation, provided that either party may bring an action for injunctive relief or to enforce a judgment or award in any court of competent jurisdiction.

11. Online dispute resolution for European consumers

The European Commission provides a platform for online dispute resolution (ODR), which you can find here and use in the event of a dispute. The use of the platform is voluntary.
